By accessing or using Xent ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms constitute a legally binding agreement between you and Xent ("we," "us," or "our"). We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Service constitutes acceptance of the modified Terms.

Xent is a privacy-focused communication platform that provides: - End-to-end encrypted messaging - Non-custodial cryptocurrency transfer capabilities - Secure file sharing - Voice and video calling The Service is provided "as is" and "as available." We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time.

**Account Creation:** - You may create an account without providing personal identifying information - You are responsible for maintaining the confidentiality of your account credentials - You are responsible for all activities that occur under your account **Account Security:** - You must safeguard your recovery phrase and private keys - Lost recovery phrases cannot be recovered by us - You agree to notify us immediately of any unauthorized use of your account **Account Termination:** - You may delete your account at any time - We may suspend or terminate accounts that violate these Terms - Upon termination, your data will be permanently deleted

You agree NOT to use the Service to: **Illegal Activities:** - Violate any applicable laws or regulations - Engage in money laundering or terrorist financing - Facilitate illegal transactions - Evade sanctions or export controls **Harmful Content:** - Distribute malware, viruses, or harmful code - Send spam or unsolicited communications - Harass, threaten, or abuse others - Share illegal content including CSAM **System Abuse:** - Attempt to hack, disrupt, or overload our systems - Circumvent security measures - Use automated tools to access the Service - Reverse engineer our software Violation of these terms may result in immediate account termination and may be reported to appropriate authorities.

**Non-Custodial Nature:** - Xent does not hold, control, or have access to your cryptocurrencies - You are solely responsible for your private keys and wallet security - We cannot reverse, cancel, or modify any blockchain transactions **Transfer Risks:** - Cryptocurrency transactions are irreversible - You are responsible for verifying recipient addresses - We are not responsible for losses due to user error - Network fees are determined by the blockchain, not Xent **Compliance:** - You are responsible for complying with applicable tax laws - You represent that you are not subject to sanctions - You agree not to use the Service for money laundering

**Our IP:** - The Service, including its design, features, and content, is protected by copyright and other intellectual property laws - The Xent name, logo, and branding are our trademarks - You may not use our trademarks without written permission **Open Source:** - Our client applications are open source under the GPL license - You may use, modify, and distribute the source code in compliance with the license - Contributions to our codebase are subject to our Contributor License Agreement **Your Content:** - You retain ownership of content you create or share - You grant us a limited license to transmit your encrypted content - We do not claim ownership of your messages or data

**Service Availability:** THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. **No Guarantees:** - We do not guarantee uninterrupted or error-free service - We do not guarantee the security of blockchain networks - We do not guarantee the value of any cryptocurrency **Technical Limitations:** - End-to-end encryption may have theoretical vulnerabilities - No security system is 100% impenetrable - You accept these inherent limitations

TO THE MAXIMUM EXTENT PERMITTED BY LAW: - We shall not be liable for any indirect, incidental, special, consequential, or punitive damages - We shall not be liable for any loss of profits, data, or cryptocurrencies - Our total liability shall not exceed the amount you paid us in the past 12 months (if any) These limitations apply regardless of the theory of liability and even if we have been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless Xent and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from: - Your use of the Service - Your violation of these Terms - Your violation of any third-party rights - Your cryptocurrency transactions

**Governing Law:** These Terms shall be governed by the laws of Switzerland, without regard to conflict of law principles. **Arbitration:** Any disputes shall be resolved through binding arbitration in Zurich, Switzerland, under the rules of the Swiss Chambers' Arbitration Institution. **Class Action Waiver:** You agree to resolve disputes individually and waive any right to participate in class actions. **Exceptions:** Either party may seek injunctive relief in court for intellectual property violations.

**Severability:** If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect. **Waiver:** Our failure to enforce any provision does not constitute a waiver of that provision. **Assignment:** You may not assign these Terms. We may assign our rights to a successor in interest. **Entire Agreement:** These Terms, together with our Privacy Policy, constitute the entire agreement between you and Xent.
